The firm secured favorable orders culminating in the dismissal of the suit proceedings in its entirety providing a huge relief to the client. The long-awaited Supreme Court decision in Roca Bathroom Products (P.) Ltd is expected to bring clarity on the debate over the interplay between Sections 153 and 144C of the Income Tax Act, 1961 and probably, bring an end to the limitation issue on the assessment orders. The root of the issue revolves around whether the draft order, as an interim step, can satisfy the outer time limits prescribed under Section 153, or whether the entire assessment procedure, culminating in the final assessment order, must adhere to the specified time limits. In their article, our Partner Sumit Mangal , along with Associates Radhika Sharma and Abhishek Rai have apprised Madras High Court’s stance on this issue and outlined the arguments that have been presented by the parties involved before the Apex Court. They have also referenced various judicial precedents from across the country, highlighting how some Courts are still in the process of adjudicating the issue, while the others (the Bombay High Court, specifically, in the case of PayPal Payments Private Limited) have directed the parties to approach once the Apex Court has rendered its decision.
